Une enquête technique et administrative peut être menée à l'échelon local à la suite de tout accident ou incident concernant un navire français en vue d'en rechercher les causes et de tirer les enseignements qu'il comporte pour la sécurité maritime.
Une telle enquête peut intervenir à la suite d'un accident ou incident concernant un navire étranger s'il se produit dans la limite des eaux territoriales françaises ou s'il est de nature à porter atteinte au littoral français.
Le ministre chargé des transports peut décider de confier l'enquête technique et administrative à une commission.
